Fireball Beach Volleyball Terms and Conditions

By entering an event or session run by Fireball Beach Volleyball Ltd or joining Fireball Beach Volleyball Club I agree to abide by the following code of conduct: 

 

Behaviour:

  1. I will behave in a friendly, welcoming and positive manner towards other players and members of the public. 
  2. I will not do anything to discourage other players from taking part or make anyone feel unwelcome at a Fireball event or session.
  3. I will not do anything to bring the reputation of the sport or Fireball into disrepute
  4. I acknowledge that I play at my own risk and that Fireball cannot accept any responsibility for injuries sustained while playing or loss of possessions while at a Fireball event or venue. 
  5. Where I am entering for a team, I confirm that I have shared these terms and conditions with my teammates and that they also agree to them. 

 

Financial Matters:

  1. I agree to pay any due fees on time or, if I cannot, to inform a member of the administrative team well in advance so that measures can be taken. 
  2. I agree that Fireball has the right to not refund me or only partially refund me should I fault to meet the refund conditions below.

 

Refund & Attendance Policy

  1. For training sessions I must give at least 48 hours notice that I will not be attending. In this case, my credit can be transferred to a future session or you can be refunded.
  2. For one-day events such as tournaments and training camps I must email hello@fireballbeachvolleyball.com or contact Fireball by another means at least 96 hours in advance in order to receive a full refund. 
  3. For multi-day events such as foreign training camps, summer camps and multi-day tournaments I must inform Fireball at least four weeks before the event start date in order to receive a full refund. 

Fireball will do its best to provide credit or refund where possible where cancellations occur later than the above deadlines. These will be treated on a case by case basis. You are strongly encouraged to contact Fireball as soon as possible if you are no longer able to attend.

 

Photo Consent

By default by signing up to a Fireball event or session you give us consent to take your photo and use it for future marketing purposes. These include:

  1. Use on social media 
  2. Publication on our e-newsletter and blog
  3. Featuring on our website and promotional materials

In rare circumstances we may pass these photos on to selected third parties, such as sponsors and promoters, where the photos feature their product or are specifically relevant to something they wish to promote. 

 

GDPR Policy:

 

Club means Fireball Beach Volleyball. GDPR means the General Data Protection Regulation. Responsible Person means Samuel Dunbavin. Register of Systems means a register of all systems or contexts in which personal data is processed by the Club.

  1. Data Protection Principles 

The Club is committed to processing data in accordance with its responsibilities under the GDPR.

Article 5 of the GDPR requires that personal data shall be:

  • processed lawfully, fairly and in a transparent manner in relation to individuals;
  • collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes;
  • adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
  • accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;
  • kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required by the GDPR in order to safeguard the rights and freedoms of individuals; and
  • processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.”
  1. General provisions 
  • This policy applies to all personal data processed by the Club.
  • The Responsible Person shall take responsibility for the Club’s ongoing compliance with this policy.
  • This policy shall be reviewed at least annually.
  1. Lawful, fair and transparent processing 
  • To ensure its processing of data is lawful, fair and transparent, the Club shall maintain a Register of Systems.
  • The Register of Systems shall be reviewed at least annually.
  • Individuals have the right to access their personal data and any such requests made to the Club shall be dealt with in a timely manner.
  1. Lawful purposes 
  • All data processed by the Club must be done on one of the following lawful bases: consent, contract, legal obligation, vital interests, public task or legitimate interests (see ICO guidance for more information).
  • The Club shall note the appropriate lawful basis in the Register of Systems.
  • Where consent is relied upon as a lawful basis for processing data, evidence of opt-in consent shall be kept with the personal data.
  • Where communications are sent to individuals based on their consent, the option for the individual to revoke their consent should be clearly available and systems should be in place to ensure such revocation is reflected accurately in the Club’s systems.
  1. Data minimisation 
  • The Club shall ensure that personal data are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.
  1. Accuracy 
  • The Club shall take reasonable steps to ensure personal data is accurate.
  • Where necessary for the lawful basis on which data is processed, steps shall be put in place to ensure that personal data is kept up to date.
  1. Archiving / removal 
  • To ensure that personal data is kept for no longer than necessary, the Club shall put in place an archiving policy for each area in which personal data is processed and review this process annually.
  • The archiving policy shall consider what data should/must be retained, for how long, and why.
  1. Security 
  • The Club shall ensure that personal data is stored securely using modern software that is kept-up-to-date.
  • Access to personal data shall be limited to personnel who need access and appropriate security should be in place to avoid unauthorised sharing of information.
  • When personal data is deleted this should be done safely such that the data is irrecoverable.
  • Appropriate back-up and disaster recovery solutions shall be in place.
  1. Breach 
  • In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data, the Club shall promptly assess the risk to people’s rights and freedoms and if appropriate report this breach to the ICO.
  1. Specific Practises
  1. Contact data will be shared with key Fireball employees for the purpose of potential uses should they arise during, before and after events or sessions. 
  2. Event attendance records will be kept for 4 years, after which they will be deleted except for their entry into the Fireball ‘halls of fame’, which tracks attendance over time.
  3. Anyone who wishes not to be displayed in the hall of fame can withdraw their name at any point. 
  4. Fireball will use given contact methods to share information about upcoming events.



Disciplinary Measures:

 

Failure to abide by the code of conduct can lead to the following disciplinary actions, as decided by Fireball’s management. 

 

  1. Written warning of future disciplinary action should the poor behaviour continue
  2. Temporary or permanent bans from events or temporary or permanent expulsion from the club
  3. Financial penalties that must be paid before attending future events or sessions

Health and Safety

Fireball is strongly committed to encouraging our members to take part, but the health, well-being and safety of each individual is always our paramount concern.

We recommend levels of training dependent on age and ability, and expect our athletes to participate within these boundaries.

HEALTH AND SAFETY POLICY:

To support our Health and Safety policy statement we are committed to the following duties:

  • Undertake regular, recorded risk assessment of the club premises and all activities undertaken by the club.
  • Create a safe environment by putting health and safety measures in place as identified by the assessment.
  • Ensure that all members are given the appropriate level of training and competition by regularly assessing individual ability dependant on age, maturity and development.
  • Ensure that all members are aware of, understand and follow the club’s health and safety policy.
  • Appoint a competent club member to assist with health and safety responsibilities.
  • Ensure that normal operating procedures and emergency operating procedures are in place and known by all members.
  • Provide access to adequate first aid facilities, telephone and qualified first aider at all times.
  • Report any injuries or accidents sustained during any club activity or whilst on the club premises directly to Samuel Dunbavin.
  • Ensure that the implementation of the policy is reviewed regularly and monitored for effectiveness.

AS A CLUB MEMBER YOU HAVE A DUTY TO:

  • Take reasonable care for your own health and safety and that of others who may be affected by what you do or not do.
  • Co-operate with the club on health and safety issues.
  • Correctly use all equipment provided by the club.
  • Not interfere with or misuse anything provided for your health, safety or welfare.

Safeguarding Policy

 

Note: The terms ‘child’ and ‘young person’ describe any person under the age of 18. References to ‘parents’ should be read as parents and carers inclusively.

 

Our statement

Fireball Beach Volleyball Ltd acknowledges the duty of care to safeguard and promote the welfare of children and is committed to ensuring safeguarding practice reflects statutory responsibilities, government guidance and complies with best practice and Volleyball England requirements.

The policy recognises that the welfare and interests of children are paramount in all circumstances. It aims to ensure that regardless of age, ability or disability, gender reassignment, race, religion or belief, sex or sexual orientation, socio-economic background, all children:

  1.     have a positive and enjoyable experience of sport at Fireball BV in a safe and child centred environment
  2.     are protected from abuse whilst participating in Fireball BV or outside of the activity.

 

We acknowledge that some children, including disabled children or those from ethnic minority communities, can be particularly vulnerable to abuse and we accept the responsibility to take reasonable and appropriate steps to ensure their welfare.

 

Our Policy

What we’ll do

As part of our safeguarding policy we will:

  •     promote and prioritise the safety and wellbeing of children and young people
  •     value, listen to and respect children
  •     ensure robust safeguarding arrangements and procedures are in operation
  •     adopt safeguarding best practice through our policies, procedures and code of conduct for staff and volunteers
  •     ensure everyone understands their roles and responsibilities in respect of safeguarding and is provided with appropriate learning opportunities to recognise, identify and respond to signs of abuse, neglect and other safeguarding concerns relating to children and young people
  •     provide effective management for staff and volunteers through supervision, support training and quality assurance measures so that all staff and volunteers know about our policies, procedures and behaviour codes and follow them confidently and competently
  •     ensure appropriate action is taken in the event of incidents or concerns of abuse and support provided to the individual(s) who raise or disclose the concern
  •     ensure that confidential, detailed and accurate records of all safeguarding concerns are maintained and securely stored
  •     record and store information securely, in line with data protection legislation and guidance
  •     prevent the employment or deployment of unsuitable individuals by recruiting and selecting staff and volunteers safely, ensuring all necessary checks are made-all staff undergo an enhanced DBS check before they start coaching
  •     appoint a nominated safeguarding lead for children and young people, a deputy and a lead board member for safeguarding
  •     develop and implement an effective online safety policy and related procedures
  •     share information about safeguarding and good practice with children and their parents via leaflets, posters, group work and one-to-one discussions
  •     make sure that children, young people and their parents know where to go for help if they have a concern

 

The policy and procedures will be widely promoted and are mandatory for everyone involved in Fireball BV.

Failure to comply with the policy and procedures will be addressed without delay and may ultimately result in dismissal or exclusion from the organisation.

 

Monitoring

This policy will be reviewed a year after development and then every three years, or in the following circumstances:

  •     changes in legislation and/or government guidance
  •     as required by the local safeguarding partnership, UK Sport and/or home country sports councils and Volleyball England
  •     as a result of any other significant change or event.
